Code Red respects your privacy and will process your personal data in a secure and careful manner, in accordance with applicable laws and regulations, including the Dutch General Data Protection Regulation (“GDPR”). This statement explains which personal data Code Red processes, for what purpose, how Code Red subsequently handles this data and for how long this data is stored. You are advised to read this privacy statement carefully.

Personal data

Code Red processes personal data within the meaning of Article 4 GDPR. Personal data is defined as: all data that can provide information about identified or identifiable natural persons. Code Red does not intend to collect data about website visitors who are under 16 years of age. If the personal data is the data of an individual under the age of 16, then reasonable consent of the parent(s) or guardian(s) is required to modify, delete or otherwise process personal data. If you believe Code Red has collected personal data from minors without consent, please contact Code Red. The data will then be deleted.

Personal data, basis and purposes

In the first place, personal data are processed when you enter into an agreement with Code Red. The data requested in any case are first and last name, address details, email address and phone number. In addition, your personal data will be processed for billing and accounting purposes. Data is collected through the contact form on the website, email contact, telephone conversations, social media or through personal conversations.

The personal data that Code Red processes are:

• first and last name;

• gender;

• address information;

• phone number;

• email address;

• company information (including Chamber of Commerce number and/or VAT number);

• payment data;

• other personal data that you actively provide to Code Red, for example in correspondence or by

• telephone.

Code Red processes this data for the following purposes:

• To correctly address or write to you using Mr. or Mrs. and your name;

• To send you offers from Code Red;

• To execute the agreement you entered into with Code Red, such as delivery

• To handle your payment;

• to inform you about changes in services and/or products of Code Red;

• if Code Red is legally obliged to do so, such as data Code Red needs for administration, invoicing,

• accounting and tax return.

 

When you visit the website, the following personal data may be processed:

• IP Address

• Cookies are used on the website. More information can be found under the heading “cookies” in this privacy statement.

Special categories of personal data

- As part of its services, Code Red may process special personal data such as health information. This data is processed solely based on our explicit consent or when necessary to provide its services. Code red takes appropriate measures to further protect this data.

 

With permission, reviews can be posted on the website and social media for our own promotion. Code Red processes your data on the basis of the consent you have given, on the basis of an agreement you have entered into with Code Red, if this is necessary to safeguard legitimate interests of Code Red or on the basis of a legal obligation. Personal data will not be processed in a manner incompatible with the purposes for which it was obtained.

 

Retention period personal data

Personal data processed by Code Red will not be kept longer than necessary to realize the aforementioned purposes for which the personal data are collected. Personal data will be kept until the legal retention period, unless otherwise necessary (Article 5 GDPR). Invoices and financial records (including company data, first and last name, address data, e-mail address and telephone number) are kept - for the purpose of the legal administration obligation of the Tax Office - at least 7 years. After this period, the data will be deleted or anonymized.

 

Sharing personal data with third parties

Code Red will not share your personal data with third parties, unless this is necessary for the execution of the agreement, to comply with accounting and other administrative obligations or on the basis of mandatory laws and regulations. These third parties are obliged to confidentiality by virtue of a processing agreement and/or legal obligation.

 

Code Red will, if necessary, enter into a processor agreement/secrecy agreement with companies processing your personal data on behalf of Code Red in order to strive for the same level of security and confidentiality of your personal data. Code Red will remain responsible for this processing. Code Red will never sell personal data to third parties.

 

Your personal data will (potentially) be shared with these third parties:

- engaged third parties, e.g. external cooperation partners, postal and delivery services, software companies, etc;

- IT partners, who provide hosting and maintenance of the website;

- collection and/or bailiff office, if this is necessary for the collection of claims of Code Red;

- payment services and systems;

- accounting program/bookkeeper;

- telecommunications.

Automated decision-making

The personal data Code Red works with is always processed by a person. Code Red does not make decisions about matters that could (significantly) affect individuals, based on automated processing. These are decisions made by computer programs and/or computer systems.

 

Your privacy rights

You have the following rights regarding your personal data in accordance with the GDPR:

- the right to be informed;

- the right to access;

- the right to rectification;

- the right to erasure;

- the right to restrict processing;

- the right to data portability;

- the right to object;

- rights relating to automated decision-making and profiling.

To exercise said rights, please send your request to contact@codered.family. Code Red will evaluate your request as soon as possible and at the latest within 30 days. If Code Red cannot fulfill your request, it will always let you know why your request has been rejected. Code Red is entitled to verify your identity, by requesting the presentation of a valid identification document, driver's license or passport, when you make such a request. In this copy, black out your passport photo, MRZ (machine readable zone, the strip of numbers at the bottom of the passport), passport number and Citizen Service Number (BSN). This is to protect your privacy.

Cookies

A cookie is a simple, small text file that is send when you first visit a website and is stored by your browser on the hard drive of your computer, tablet or smartphone. These files store information that can be recognized on subsequent visits on the website. Code Red uses necessary cookies, which are essential for its website operation. Code red also uses analytical cookies which are being used to track your behavior on the website. These cookies track users across websites, with the intention of showing relevant ads to individual users.

All cookies placed have retention periods which vary from a single session up to a maximum of one year and one month. In summary, the website places the following types of cookies, all associated with the coderedcare.com domain:

  • Strictly necessary cookies (e.g. woocommerce_items_in_cart, wp_woocommerce_session_, woocommerce_cart_hash, wcf_active_checkout, woocommerce_recently_viewed) — used to support shopping cart and checkout functionality and to remember visitor selections during a session. Retention: session-based, ranging up to around 29–36 minutes for checkout-related cookies.

  • Analytical cookies (e.g. the sbjs_ cookie family, including sbjs_current_add, sbjs_migrations, sbjs_first_add, sbjs_current, sbjs_first, sbjs_udata, sbjs_session) — used to track visitor behavior, sessions, and traffic sources in order to analyze and improve website and marketing performance. Retention: mostly session-based, with sbjs_udata retained for up to 1 year and 1 month.

Social media buttons

Code red’s website includes social media buttons to promote web pages on social networking sites like Facebook, LinkedIn, Spotify, and Instagram. These buttons are using pieces of code provided by these parties themselves. Code red therefore recommends that you carefully read the privacy statements of these parties in order to understand what they do with your personal data that they process. Code red has no influence on that.

Code Red handles your personal data with care and takes appropriate technical and organizational measures to protect personal data against loss, destruction or unlawful use, which are reasonable given the costs involved and the nature of the personal data.
